Family Trusts and Succession Planning

With a significant number of Trusts and Estates in New Zealand, these require a high standard of care and attention. We provide quality administration and management for successful planning. We help in looking after your assets and investment affairs.

What is succession planning? There are two principal areas. First to cover a situation when a farmer or business proprietor wishes to arrange for an orderly and in some cases progressive transfer of ownership to the next generation, and secondly providing a plan whereby assets are transferred either by will or during the client's lifetime (often by means of a Family Trust). This should be done so as to protect the living standards of the older generation and at the same time meeting their wishes as to the ultimate distribution of their estates.

Wills & Powers of Attorney & Estates

There have been some significant changes over recent years to the laws relating to personal and property rights and also to the duties of trustees of Trusts and Wills.

It is important for any person considering making or revising a Will to be aware of these changes. Wills should be updated from time to time as family and financial circumstances alter.

Wills should be designed so that, where appropriate, there is financial security for a spouse or partner and an equitable division is made to other beneficiaries (usually children) recognising their needs and any benefits they may have received in the testator's lifetime.

Legislation enables people to make what are called Enduring Powers of Attorney to become effective if a person should lose their legal capacity through injury or ill health. Enduring Powers of Attorney can cover property and also personal care and welfare.

The Property (Relationships) Act 1976 (formerly the Matrimonial Property Act 1976) is aimed at providing the legal rules on how property should be divided when a marriage, civil union or de facto relationship ends.
